A MAN who police claim assaulted three officers after being arrested on a Toowoomba street at the weekend has been held in custody.
Police had been called to a report of a man trespassing on private property in Greenwattle St on Sunday and arrived to find an agitated Michael James Mostyn in the middle of the street.
Officer in Charge of Toowoomba Police Station Senior Sergeant Anthony Neumann said the 42-year-old Wyreema man had allegedly kicked out at officers.
“When the officers went arrest him he had proceeded to kick them in the head,” Snr Sgt Neumann said.
It is alleged Mostyn had kicked one officer in the head and kneed another in the head leaving both officers with concussion like injuries.
Snr Sgt Neumann said when taken to the watch house, it is alleged the 42-year-old spat in a watch house sergeant’s face.
Mostyn has been charged with public nuisance, obstructing a police officer, serious assault of police, serious assault of a police officer by biting or spitting etc., three counts of serious assault of a police officer causing bodily harm and trespassing.
He has not as yet been called upon to enter pleas to any of the charges.
He was taken to Toowoomba Hospital Monday morning and so was not in Toowoomba Magistrates Court when his matters were mentioned.
Police prosecutor Rohan Brewster-Webb said police sought a disease test order.
Acting Magistrate Lisa O’Neill granted the disease test order with a sample of blood to be taken from Mostyn while at the hospital and adjourned the case for mention back in the same court tomorrow with the defendant to remain under police guard at the hospital.
