Failing to provide stat dec costs Toowoomba man $1750 fine
He said he had not reported his car stolen because he didn’t talk to police, the court was told.

A TOOWOOMBA man who claimed to have an aversion to speaking with police has copped a $1750 fine for failing to provide a statutory declaration as required.
Police prosecutor Leea Trewin explained to Toowoomba Magistrates Court that the saga arose from the attempted intercept by police of a vehicle being driven on a Toowoomba street in June last year.
Police spotted the car and went to direct the driver to pull over but the car had driven on, Senior Constable Trewin told the court.
Due to safety procedures, the police patrol didn’t pursue the vehicle and it had driven on in what was a police evasion offence, she said.
However, police took down the car’s registration and later contacted the car’s owner, Kyle James Frost.
When spoken to by police, Frost agreed the car was owned by him but he denied driving it at the time of the alleged evasion offence.
He told police that his car may have been stolen at the time, Snr Const. Trewin said.
Asked if he had reported the alleged theft of his car to police, the 27-year-old said he had not as he didn’t talk to police, she said.
Police then advised Frost that he would be required to provide a statutory declaration nominating the driver of the vehicle at the time.
However, he had failed to provide the statutory declaration at all and was subsequently charged.
He appeared before the court on Friday to plead guilty to one count of “failing to give a statutory declaration”.
The court heard the 27-year-old maintained he had not been driving the vehicle at the relevant time.
Magistrate Graham Lee noted Frost had been subject to a parole order at the time and berated him for not complying and providing a statutory declaration.
Noting his criminal history which included serious offences for which he had received jail terms in the past, Mr Lee convicted and fined Frost $1750.
