Vodka shots and gastric bypass lead to driver’s high reading

A Toowoomba driver who blew a breath/alcohol reading more than four times the legal limit told police he had drunk two shots of vodka.

Noel James Willis told Toowoomba Magistrates Court that since having a gastric bypass alcohol went straight to his system.

Willis, 54, blew 0.221 after being pulled up by police called to a crash on West Street about 6.30pm, April 25, police prosecutor Bettina Trenear told the court.

The self-represented Willis pleaded guilty to driving while under the influence of liquor.

He said he was studying nursing and asked for a higher fine and lower disqualification period.

Magistrate Howard Osborne fined him $2800 and disqualified him from holding or obtaining a driver’s licence for the minimum six months.
