A Toowoomba man accused of biting and choking a former girlfriend has had a bid for bail put on hold, after police objected to him living with his mother.
Jack Whiting, 29, applied for bail at Toowoomba Magistrates Court, however the part heard application was adjourned to January 15, 2024 so an alternative bail address could be found.
The court heard if granted bail, Whiting intended to live with his mother.
Police prosecutor Anita Paige said the woman had a “significant” criminal history and provided an alibi for her son.
The court heard Mr Whiting’s mother told officers her son was with her when the alleged domestic violence incident occurred, and she was certain given it was her dead son’s birthday.
Ms Paige said the woman told officers she would not attend the station to make a sworn statement given what she said was captured on officer’s body-worn camera footage.
When police questioned Whiting at a public toilet block, he made admissions to officers that he was at the alleged victim’s home at the relevant time.
Magistrate Louise Shepard said it would not be appropriate for Whiting to be bailed to his mother’s address where the opportunity to collaborate may arise given the inconsistencies in Whiting’s version of events.
The court heard the pair’s short-term relationship soured after Whiting recommenced communicating with the woman’s sister – who Whiting also dated in the past.
He is alleged to have returned to the woman’s home after the relationship ended to fix damage before an upcoming real-estate inspection, which is when the alleged violent incident occurred.
Police prosecutor Anita Paige said the bail application was opposed, noting Whiting had a significant criminal history which included acts of violence, domestic violence offences, drugs, and breaching court orders.
Mr Whiting remains in custody on remand for the following charges; assault occasioning bodily harm, choking/suffocation/strangulation in a domestic setting, possessing drugs, possessing a knife in public, and stealing.
