Toowoomba Magistrates Court: Break-up led to Robert James Muller stealing from Tatts and Rozzis restaurant

Hours after a failed relationship left a former homeless man heartbroken, he stole a bottle of rum from a pub, which landed him back before the justice system.

A former homeless man spent a night in the Toowoomba watch-house after he went on a stealing spree fuelled by alcohol and a broken heart.

A distraught Robert James Muller appeared at Toowoomba Magistrates Court on Thursday morning, August 10, after he was caught stealing alcohol, soft drink, and food.

Police prosecutor Senior Constable Alister Windsor said two businesses fell victim to Muller on Monday, August 7 – the Tatts Hotel and Rozzis Italian restaurant at Grand Central Shopping Centre.

Senior Constable Windsor said the 40-year-old man was caught on CCTV taking drinks and food from the fridges of the restaurant, however when police spoke to him about it days later he admitted to another offence.

Muller told officers he went to Grand Central to buy soft drink to accompany a bottle of rum he had taken from Tatts about 6pm, and that’s when he noticed Rozzis was closed and the fridges were accessible.

When Muller left the shopping centre, the court was told he gave some of the food away to people living on the street, as he had been recently homeless.

While acting as duty Lawyer, Alysha Jacobsen told the court Muller recently secured a rental.

She said when Muller stole the items he was very upset over a recent break-up as he just found out there was no hope of a second chance.

Whenever Muller’s former partner was brought up during the proceeding, he burst out crying.

The court was told Muller had an extensive criminal history which included, stealing, property, and drug offences, which magistrate Louise Shephard said fit the narrative of a man who was struggling with drug addiction and living on the street.

She also noted Muller was on a suspended prison sentence for failing to appear when he committed the most recent crime.

Muller pleaded guilty to stealing, entering a premises to commit a crime, and was sentenced to a four month jail term with immediate parole.

Ms Shephard declared the day he spent in custody as time served.
