Toowoomba Magistrate Court briefs: Outcomes and sentences from court this week

From possessing a knife in public to drink and drug driving, here are the offenders sentenced in Toowoomba Magistrates Court this week.

The following offenders were convicted by magistrate Graham Lee in Toowoomba Magistrates Court on Tuesday, July 13:

• Ian Wilson Peacock, 59, pleaded guilty to driving a motor vehicle while a relevant drug was present in his blood or saliva. The court was told Peacock was stopped by police at 4pm on April 27 this year, and an analysis of his saliva detected the presence of methylamphetamine. Peacock was convicted, fined $900 and disqualified from holding a driver’s licence for seven months.

• Dwayne Julian Washington, 28, pleaded guilty to wilful damage. Court documents reveal that on May 29 this year a neighbour reported to police seeing Washington yelling and screaming at the front door of a home in Wilsonton. Police arrived to find the wooden door damaged, and a glass panel smashed. Washington, who was also sentenced on two unrelated matters, was handed a 12 month prison sentence and was immediately released on parole.

• Bradley James Walker, 24, pleaded guilty to stealing a $59 baby car seat from Big W in Clifford Gardens. The court was told at 2.20pm on March 16 this year Walker pretended to pay for another item at the store’s self checkout before leaving the store, ignoring efforts from staff to stop him. Walker, which the magistrate described as having a “quite terrible history for property offences” was convicted and ordered to pay $59 restitution to Big W.

• Chantelle Louise Brown pleaded guilty to two charges of driving a motor vehicle while a relevant drug was present in his blood or saliva, possession of a knife in a public place and possessing utensils or pipes that had been used. The court was told Brown was stopped by police in Toowoomba on February 25 this year where a roadside drug test returned a positive reading for methylamphetamine, and a search of her car uncovered a 10cm fishing knife. Brown was also found to be in possession of a glass pipe on March 4, and was again found drug driving on March 5. Brown was convicted, fined a total of $1300 and disqualified from driving for six months.

• Jason Mark Dwyer, 40, pleaded guilty to possessing a dangerous drug. The agreed facts reveal that on June 27 this year police attended a disturbance at the intersection of Hume and Bridge streets where they found Dwyer outside a 7-Eleven store. Police spoke to Dwyer, and when asked if he had drugs on him replied “not that I know of”. A search of his wallet uncovered about 2.8g of cannabis. Dwyer was convicted, fined $500 and his suspended sentence was extended for three months.
