A Toowoomba jury has found a southwest Queensland man guilty of preying on three young and vulnerable teenage boys.

After a day of deliberation, the jury convicted Robert Andrew Scott Head, 28, of two charges of sexual assault, and one charge of the indecent treatment of a child under 16.

However, they acquitted him of a number of charges which related to the victims and two other complainants – the charges dropped included three counts of the indecent treatment of a child under 16, sexual assault, and distributing an intimate image.

The court was told on two different occasions Head took advantage of the vulnerable teenage boys - one 16-year-old who was passed out drunk, while the other was drunk and vomiting.

Crown prosecutor Emily Coley said Head’s crimes were brazen and he showed no remorse.

The first victim had been drinking at a party, before passing out on a mattress.

The court was told Head rubbed the boy’s leg while he slept, before the 16-year-old woke to find Head’s hand in his shorts rubbing his thigh and grazing his penis.

The second sexual assault also occurred at a party.

A 16-year-old boy, to whom Head gave homemade alcohol, left the party to vomit outside when Head tried to kiss him before putting his hand down the boy’s pants and grabbing his penis.

The indecent treatment of a child charge was in relation to Head sending a picture of his penis to a 14 or 15-year-old boy.

Brisbane barrister Cecelia Bernardin told the court Head had no criminal history, and was working at a Commonwealth Bank call centre in Tasmania.

Ms Bernardin said Head grew up in a town west of Toowoomba, where he was bullied as a child, however he now lived with his parents and partner in Tasmania.

They had moved in late 2020 – the same time Head was charged and placed on bail in relation to the offences.

Judge Brad Farr SC said Head showed no remorse for his actions and noted the victims had to endure the witness stand where they were accused of lying and having motives.

Judge Farr SC said aggravating features of the Head’s crimes included the large age gap between him and the victims, their vulnerable state, and the multitude of victims.

Head was sentenced to a 12 month jail sentence.

During the trial, Head was supported in court by his boyfriend and mother.

After Head was sentenced he held onto his mother and sobbed into her shoulder – his mother’s sorrow could be heard from outside the double-doored courtroom.

Head will be eligible to apply for parole on November 8, and once released, he will be on the child sex offender registry for at least five years.
