Police accuse Toowoomba man of making, sharing child exploitation material

A Toowoomba man accused of making and controlling child exploitation material applied for the court to change his bail conditions to include internet access.

Police alleged a young Darling Downs man purposefully sought out an underage person to make and distribute child exploitation online.

On Thursday, February 22, Caedan James McKay Logan had his case mentioned before the Toowoomba Magistrates Court, where his lawyer submitted an unopposed application to vary his bail conditions.

Criminal lawyer Nathan Bouchier said he previously made an application to allow his client internet access, however it was rejected because no material was submitted to the courts to back up their claims.

I (have now) obtained a report from my client’s treating physiologist… it’s about four pages long,” Mr Bouchier said.

“We have proposed a replacement condition which would actually, I think, provide for a more meaningful way of police monitoring of (Mr Logan) and ensuring there be no further offending.

“He has been on bail for some time with no issues and this matter could drag on for some time.”

The Bouchier Khan Lawyers managing director noted there had been a delay in the case as his office was waiting on a forensics report from a doctor.

“We did anticipate we would have that report but it has not arrived,” he said.

Police charged the 19-year-old with eight offences which included, procuring a young person for sexual purposes, involving a child in making child exploitation material, using a hidden online network to obtain child exploitation material, and possessing and controlling child exploitation material for use online.

The court heard police seized a number of devices during a raid, which included a family computer that had cache files left behind when Mr Logan backed up his personal devices.

Mr Logan was supported by his family in court, and was ordered to sign his new bail undertaking before leaving the precinct.

His case will next be mentioned before the courts on April 4.
