Nathan Gay has bail revoked in Toowoomba Magistrates Court for dangerous driving causing death charge

A man accused of dangerous driving causing the death of a close friend has voluntarily entered into custody on remand, despite the court granting him the freedom to remain in the community until his charge is resolved.

The man accused of causing a crash that killed his close friend has voluntarily entered into custody on remand despite the Toowoomba Magistrates Court granting him bail about five weeks ago.

Oakey man Nathan Gay walked into the Toowoomba Courthouse flanked by family members on May 30 and had his lawyer make the “unusual” request.

Dan Rodgers, of Robertson and O’Gorman Solicitors, told the court he had received a brief of evidence and that the matter was ready to proceed.

“I have a signed registry committal with an indication of a plea of guilty which I will provide to police prosecutions now,” he said to the court.

Mr Rogers asked for a three-week adjournment to allow the paperwork to be filed and processed.

“Mr Gay wishes to have his bail revoked,” he said.

Police will allege in court Mr Gay was intoxicated and speeding while behind the wheel of a Chrysler sedan when he crashed into the rear of a Toyota LandCruiser on the Warrego Highway at Bowenville about 7pm on November 15.

Jayson Halpin, 50, of Wilsonton, suffered a critical head injury and was killed instantly.

A second male passenger in the Chrysler and the driver of the LandCruiser were hospitalised.

After extensive investigations by the Forensic Crash Unit, Mr Gay, 37, was charged with one count each of dangerous operation of a motor vehicle causing death while adversely affected by an intoxicating substance while excessively speeding, and did drive UIL.

Magistrate Kay Ryan revoked Mr Gay’s bail and held him on remand to appear in the same court on June 20, to allow the registry committal to take place.

Ms Ryan then directed Mr Gay to enter the dock and wait for a police officer to take him into custody.

“It was an unusual request,” she said.

“I had to ask about it twice this morning when it was put before me,” she said.

“It is an acceptance of responsibility,” Mr Rogers replied.
