A Toowoomba court has refused a bail application from two Brisbane men after an alleged baton and taser assault at a Drayton home.

Mitchell Delaney Handcock and Jason Charles Parlett appeared via videolink, both separately applying for bail at Toowoomba Magistrates Courthouse on Monday, April 29, 2024.

Both men face allegations that they drove from Brisbane that night to a Drayton address early on Saturday, April 27 and allegedly assaulted a man, who is the partner of Handcock’s sister.

The court was told that when the police arrived at the address, they observed the alleged victim with “numerous bruising to his arms, legs, and body and marks that he said was the result of a tasering application”.

During Mr Parlett’s bail application, magistrate Louise Shephard read out an unsigned victim’s statement.

She told the court how the statement said the alleged victim was woken by a bang and noticed his CCTV cameras had moved, he then moved them back to “see someone in a grey hoodie and a mask banging on the front door with what looked like a wooden axe handle”.

After that police allege the power was cut to the house, the glass panels of the front door smashed in and someone reached in and unlocked the door.

According to the complainant, he was then allegedly hit by batons by both men, and tasered multiple times. The court heard how his wounds matched police observations.

Police allege that as they were chasing the men from the house, Mr Parlett attempted to taser a police dog before he was forced to the ground and arrested by police.

Mr Parlett, through his lawyer Alysha Jacobsen, disputed his involvement, and said he had remained in the front yard during the alleged incident, and did not understand the context of what was happening when Mr Handcock asked for his assistance.

Mr Parlett, who the court was told was a 32-year-old construction worker from Caboolture with limited criminal history, was refused bail.

During Mr Handcock’s bail application, Ms Shephard told the court how “police observed you and your (alleged) co-offender running from the home and the dogs quickly tracked you and located you in nearby shrub with masks, gloves, tasers and batons”.

“You (Mr Handcock) told the police that you drove to the victim’s house after hearing he had been physically abusing his partner.”

The court was told how Mr Handcock worked as an Isuzu spare parts interpreter, is a father-of-two, lives in Deception Bay and has no relevant or significant criminal history.

“It is mind-boggling to me that you would make this decision,” Ms Shephard said.

Both men were refused bail.

Mr Parlett has been charged with two counts of assault occasioning bodily harm while armed, two counts of unlawful possession of weapons, one count of entering a dwelling with intent, one count of an attempt to injure a police dog, and one count of obstructing police.

Mr Handcock has been charged with two counts of assault occasioning bodily harm, two counts of unlawful possession of weapons, one count of entering a dwelling with intent, one count of obstructing police, one count of possessing dangerous drugs, and one count of possessing drug utensils.

Both men are expected to appear separately in Toowoomba Magistrates Court for a committal mention on 17 June 2024.

No plea was entered.
