Michael Wade Hearn appears in Toowoomba Magistrates Court following dramatic South Toowoomba arrest

The 23-year-old, who was wanted on a number of warrants, was arrested by police atop the roof of a Toowoomba house in dramatic scenes but when he appeared in court, things didn’t go his way.

A 23-year-old man who tried to avoid police arrest by climbing onto a Toowoomba house roof has made a less than auspicious appearance in court where he allegedly called the magistrate “dog head”.

Michael Wade Hearn had been wanted on warrants when police attending a disturbance in Sheehan St, South Toowoomba, about 11.40am, Tuesday, spotted the 23-year-old.

Hearn allegedly did a runner, climbing onto a nearby roof but was eventually talked down by police and arrested.

He spent the night in the Toowoomba watch house before appearing via video link to Toowoomba Magistrates Court on Wednesday.

His solicitor Kirsty Smith told the court her client wanted to plead guilty to all nine charges which included attempting to enter a dwelling with intent, unauthorised possession of explosives, enter premises with intent, enter premises and commit offence by break, two counts of receiving tainted property and three of unlawfully using motor vehicles.

However, magistrate Louise Shephard said she couldn’t hear the matters as there was no pre-sentence custody certificate.

Ms Shephard also noted Hearn was subject to parole and asked if he was on a return to prison warrant.

Ms Smith confirmed Hearn was on parole and there would be no application for bail.

Ms Shephard said she wouldn’t take formal pleas of guilty but would adjourn the matters for a “lengthy plea”.

Ms Shephard remanded Hearn in custody and adjourned his charges for a lengthy plea back in the same court on February 7 with Hearn to appear by video from the prison.

It was then Hearn was heard to mumble something from the watch house.

“Did he just call me ‘dog head’?” Ms Shephard asked.

“That’s very rude, we’ll cut the (video) link.”

Ms Shephard said she would note Hearn’s comment.
