Man who exposed penis to police told to address his drunkenness

A drunken man who exposed his penis when arrested by police has been told by a Toowoomba magistrate to address his alcohol consumption.

Ajak Deng Biar had a history of public drunkenness, Magistrate Graham Lee noted.

On January 7 about 6pm a police patrol had been flagged down by a member of the public pointing to Biar who was slumped against a wall on Prescott St.

Smelling of liquor and slurring his words, Biar tried to stand as police approached but fell over, police prosecutor Shelby Larcombe told Toowoomba Magistrates Court.

As police conducted a patdown search of him, the 48-year-old had pulled down his pants and took his penis out, she said.

Granted bail, Biar had then failed to report to police as required on his bail three times and failed to front court twice, later telling police he thought his court matters had been finalised.

Biar appeared by video link from the watch house to plead guilty to all charges.

Duty solicitor Brad Skuse said he was as confused as his client as to how the matter got to court.

His client had been dealt with for a breach of probation earlier this year but the other matters had somehow remained.

His client had spent a night in custody, he said.

Mr Lee said Biar had a history of public drunkenness for which he had been on probation which had since been revoked.

“You’ve got to address your alcohol issues,” Mr Lee told Biar who was fined $750.
