Man inappropriately touched woman neighbour while doing odd jobs for her

After twice being sexually assaulted the woman went to police and the man pleaded guilty in a Toowoomba court.

A 58-year-old man who twice tried to sexually assault his neighbour has been placed on 18 months probation to address his problems.

The Toowoomba Magistrates Court heard the woman victim, 59, had a broken leg at the time, and her next door neighbour had been helping her with various odd jobs about the home.

She had arrived at her home just north of Toowoomba on July 19 and was unpacking her shopping when her neighbour came over to help, police prosecutor Bettina Trenear told the court.

While they were on the veranda, the man had tried to put his hand under the bra of the woman who pushed back.

During the struggle her breast had been exposed and was left with an 8cm scratch, Ms Trenear said.

He said: “I had to have a look at those boobies, they’re so great,” she said.

The woman told him that if he did that again she would call the police.

He told her that he had acquired a brain injury from a vehicle accident and he “was forthright with women he finds attractive”, Ms Trenear said.

The very next day when the woman was in her car parked outside her house, the man had approached.

During the conversation he reached into the car and put his hand between the woman’s legs while making sexual suggestions, Ms Trenear said.

On another occasion, she had arrived home to find the man painting her veranda with a cord plug into a socket inside the house.

The woman did not give him permission to go into her home, and when she looked around she found her bed clothing ruffled.

The man, who is not named so as to protect the identity of the woman, pleaded guilty to two counts of sexual assault and one of trespassing.

Duty solicitor Phil Stainton told the court the man was a disability support pensioner due to his brain injury, but accepted his behaviour was unacceptable.

His client had lived next door to the complainant for about 12 months and had been doing odd jobs for her since she broke her leg, he said.

Magistrate Damian Carroll placed the man on 18 months probation.
