The case against a 25-year-old man charged with murder arising from the death of Toowoomba man Thor Morgan has taken an important step forward to the matter getting to hearing.
Lachlan Mark Freund has been held in custody since his arrest months after the death of Mr Morgan in March 2022 and was not required to be in Toowoomba Magistrates Court on Friday, January 12, when his case was mentioned.
His solicitor Abdul Rashidi, of Alexander Rashidi Lawyers, told the court the murder charge had already gone by way of registry committal up to the Supreme Court while a registry committal on the associated charge of arson of a motor vehicle had also been sent to the District Court.
Mr Rashidi asked that an associated unlawful use of a motor vehicle charge arising from the same alleged incident also be directed by Magistrate Patricia Kirkman-Scroope to be sent up to the District Court to join that arson charge.
One last charge under the Weapons Act could simply be adjourned, he said.
Mr Freund is charged with murder arising from the death of Mr Morgan who police claim was shot while driving on Ruthven St north near Downlands College in the early hours of March 25, 2022.
Mr Morgan was treated in a Brisbane hospital and appeared to be recovering before succumbing to his injuries and he died in May of 2022.
Mr Freund has not as yet been required to enter any pleas to the charges as neither has his co-accused Tina Kathleen Hazard, 36, who is also charged with murder arising from Mr Morgan’s death.
Ms Hazard’s case is progressing through the courts and she remains in custody.
Magistrate Kirkman-Scroope acceded to Mr Rashidi’s request and directed that the unlawful use of a motor vehicle charge be transferred up to the District Court to join the arson matter.
She remanded Mr Freund in custody and adjourned the weapon’s matter for mention back in the Magistrates Court on April 12.
