A 35-year-old father of three with a “shocking history” of domestic violence has been jailed for his latest offending.
The man had 13 pages of criminal history which included 19 offences of domestic violence, 11 in the last five years, Toowoomba Magistrates Court heard.
He and the mother of his three children had an “on and off” relationship for the past 13 years, the court heard.
As part of the domestic violence protection order against him, the man was prohibited from going to the woman’s Newtown home.
However, he was drunk when on July 10 he turned up at her home about 4.30pm demanding to be let in.
The woman locked herself inside in fear and told him to leave.
However, he refused and then tried to gain access via the back door by attempting to pry it open with a broom handle he’d snapped in two.
When she said she’d call police, he told her to go ahead as he banged on windows while yelling “(her name) you dog, open the f***ing door, you maggot.”.
He also smashed a rake against the back door.
Police arrived to find the man asleep outside the property.
He spent the ensuing 27 days in jail from where he appeared via video link to plead guilty to that incident as well as to damaging the side mirror of a car the night before when he had been walking drunk in the middle of Holberton St, forcing drivers to take evasive action to avoid hitting him.
His solicitor Claire Graham, of Skuse Graham Lawyers, said alcohol was her client’s biggest problem.
“When he starts drinking, he doesn’t stop,” she said.
After he was released from jail on February 24, he had been working but was put off due to a downturn in business.
However, he had tried to remain offence free and attended Lives Lived Well for counselling but in July had reverted to alcohol abuse, Ms Graham said.
Her client’s full-time release date on his last sentence was October 23, she said.
Magistrate Kay Ryan described the man’s offending as “despicable, deplorable and unacceptable”.
“You have a shocking history for a number of things but particularly for domestic violence offences,” she told him.
Ms Ryan sentenced him to nine months in jail but, taking into account delays in parole board hearings, ordered the whole term be suspended for two years, meaning he will be released after on October 23.
The domestic violence order against the man was extended to August 2026.
