Significant steps toward self rehabilitation had saved a 25-year-old woman convicted of having a large amount of meth from being returned to jail.

Emily Jane Tierney had spent five and a half months in custody after her arrest which had been a wake up call for her, Toowoomba Supreme Court heard.

“Your first time in custody must have been horrifying for you, but it’s had a positive effect on you,” Justice Martin Burns told her.

Crown prosecutor Nicole Friedewald told the court a police search of a man’s home in Oakey on February 7, 2020, found an amount of cannabis and 42.214g of substance of which 32.6g was found to be pure methylamphetamine.

The home occupant said the cannabis was his but that he had only been holding the meth for a friend.

While police were still at the home, Tierney turned up and took responsibility for the meth, Ms Friedewald said.

Tierney pleaded guilty to possessing meth above the 2g schedule and supplying the drug to another.

Her barrister Frank Martin said his client had gone “cold turkey” to get off the drug while she was in custody and had been clean since.

She was released from jail on bail on January 21 and hadn’t reoffended since, he said.

She had also been attending AODS (Alcohol and Other Drugs Service) of her own volition, Mr Martin submitted.

Justice Burns acknowledged Tierney’s efforts at self rehabilitation prior to sentence.

“Since your release (from custody) you’ve done everything you can to rehabilitate,” he told her.

Finding she was a “low risk” of reoffending, Justice Burns sentenced Tierney to three years in jail but, declaring 171 days pre-sentence custody as time served under the sentence, ordered she be released on parole immediately.
