A Toowoomba drink-driver has put the ’roo in the stew, blaming the marsupial for causing his car crash on a Newtown street.

A driver who claimed he crashed his car on a Toowoomba street while trying avoid a kangaroo blew a breath/alcohol reading almost four times the legal limit.

Terrence Graham Bermingham crashed his Ford Ranger on Taylor Street, Newtown, about 11.50pm, May 2, Toowoomba Magistrates Court heard.

Asked what had happened, the 32-year-old told police he had been drink driving and had swerved to avoid a kangaroo, police prosecutor Rohan Brewster-Webb told the court.

He told police he’d been drinking at the Irish Club Hotel since 4pm and had his last drink just prior to driving.

Bermingham blew a breath/alcohol reading of 0.184.

He pleaded guilty to driving while under the influence of liquor and not having proper control of a vehicle.

His solicitor Brad Skuse, of David Burns Lawyers, told the court the crash had already had a significant impact on Bermingham with his car sustained $8000 in damages.

His client had entered a plea of guilty at the first available opportunity and in a letter tendered to the court his employer spoke highly of him, Mr Skuse said.

Noting Bermingham had no similar offences in his history for at least nine years, Magistrate Graham Lee fined him $1700 and disqualified him from holding or obtaining a driver’s licence for nine months.
