Court briefs: Toowoomba Magistrates Court outcomes

From drug possession, breaching bail and failing to appear in court here are some of the convictions recorded in Toowoomba Magistrates Court on Thursday, July 15.

The following offenders appeared before acting magistrate Roger Stark in Toowoomba Magistrates Court on Thursday, July 15, 2021:

• Debbie Jane Richards, 32, pleaded guilty to contravening a direction or requirement of police, failing to properly dispose of a needle and syringe and possessing utensils or pipes that had been used.

The court was told that on June 17 police went to Richards’ Toowoomba address after she had failed to attend Toowoomba Watchhouse in March to have her identification recorded in compliance with court directions related to an unrelated matter. When police executed a search warrant drug paraphernalia for the use of cannabis and methylamphetamine was found.

Richards’ solicitor Michael Corbin said it was “quite clear from my client’s recent offending history that (drugs have been) an issue for her” but had made “full and frank admissions” to police during the search. Richards was convicted, fined $100 and a four month prison sentence, with immediate parole.

• Michael Andrew Peachey pleaded guilty to possessing property suspected of having been acquired for the purpose of committing a drug offence, possessing utensils or pipes that had been used, possessing anything used in the commission of crime and possessing dangerous drugs.

The court was told that police executed a search warrant at an address in Harristown at 9am on June 24 this year which uncovered 2.5g of cannabis and a number of drug items including water pipes, cone pieces, a grinder and electronic scales. Peachey, who was self-represented, said that he was “trying his best” to use prescribed cannabis legally to treat several medical issues including epilepsy and Crohn’s disease.

Peachey was convicted and fined $600.

• Aimee Jean Breeze, 26, pleaded guilty to two charges of breaching bail conditions.

The court was told Breeze was granted bail in Toowoomba Magistrates Court for unrelated matters on February 8, 2020 that included a condition to report to Toowoomba Police Station, however on February 1 this year failed to report as required. As a result of the failure to appear, and another unrelated warranted she was arrested and was entered into another bail agreement which had a curfew restriction. On February 15 police arrived at the property to conduct a check, but Breeze was not there and was arrested again later that same day.

Breeze was convicted and fined $300.

• Raymond John Schafer, pleaded guilty to three charges of failure to appear in accordance with a bail undertaking.

The court was told Schafer had been released on bail for three separate sets of unrelated offences, however on July 9 failed to appear in Toowoomba Magistrates Court. He was arrested on three outstanding warrants when he attended Toowoomba Police Station on July 14 as part of reporting conditions for another matter.

Schafer’s solicitor Ryan McCullough said his client was unwell on the day he was due to appear in court and had sent an email advising the court of that, however it was rejected by the court.

Schafer was convicted and fined $350.
