Update: A third person has been charged in connection to the alleged murder of a North Toowoomba man.

Toowoomba detectives charged a 33-year-old North Toowoomba woman on December 30 following investigations into the death of a 53-year-old man at a North Toowoomba property on December 23.

Police allege they had responded to calls for a welfare check at 11.30am on December 24 when they located the 53-year-old man deceased at a Ruthven Street address.

Police will allege the woman assisted two men, aged 29 and 32, in an attempt to conceal the alleged homicide.

The woman was charged with accessory after the fact of murder and she is due to appear in the Toowoomba Magistrates Court tomorrow, December 31.

Original story: TWO men have been charged with murder arising from the death of North Toowoomba man Len Andrew Hegarty who was found dead inside a Ruthven St north home on Christmas Eve.

Aaron John Leslie Bunt, 29, of North Toowoomba, and Oakey man William John Currey, 32, were initially charged with grievous bodily harm after the 53-year-old man’s body was found just before noon on Friday.

However, following a post mortem examination of Mr Hegarty’s body on Monday, police upgraded that charge to murder which was preferred against both accused men in Toowoomba Magistrates Court on Tuesday.

Neither accused was required to be in court for the mention of their matters and both were remanded in custody as the Magistrates Court does not have jurisdiction to hear a bail application on a charge of murder.

Any application for bail would have to be put before the Supreme Court.

Because the murder charge replaced the grievous bodily harm count, police prosecutor Sergeant Natalie Bugden formally withdrew the charge of grievous bodily harm.

The cause of death has not been released by police and no particulars of the case or the allegations against the accused have as yet been aired in open court.

Neither accused has as yet been called upon to enter any plea to the charge.

Bunt is also charged with two counts of assault occasioning bodily harm believed to also be against Mr Hegarty.

Acting Magistrate Damian Carroll remanded both accused men in custody.

He adjourned their respective cases for committal mention back in Toowoomba Magistrates Court on February 24.
