A woman sobbed loudly in a courtroom after being told she would spend time behind bars for biting a police officer, leaving them exposed to disease transmissions.

A young woman was heard sobbing loudly in a courtroom, visibly shocked by the sentence she had just received while officers came to arrest her and take her to jail for biting a policewoman months earlier.

Kylie Margaret Breuer appeared in Townsville Magistrates Court recently, dressed in a denim skirt and tank top, seemingly unaware that she would be spending the next few months behind bars.

The 26-year-old was flanked by her parents who were supporting her in the courtroom as Police Prosecutor Tim Madsen read out the details of her offences.

He told the court on August 18 last year police who were conducting an investigation took up with the woman at the Cascade Motor Inn on Bowen Rd before she became aggressive and started swearing and yelling at them.

“While detained she said ‘I will kill you, I will f--king go to jail for killing you’ and was calling police c--ts,” Mr Madsen said.

“Police told her she was under arrest, she struck and kicked out at the officers while being restrained and bit the officer on the right hand breaking the skin.”

The prosecutor said the policewoman received minor injuries with bruising and swelling but had to undergo a disease test.

Magistrate Viviana Keegan who elaborated on the offence details said two clip seal bags of 0.44g of methamphetamine was found by police after they saw the woman’s son pull them out of a bag in the back seat of her car.

The woman’s defence lawyer who said her client had no criminal history before the assault, accepted there was no excuses for her behaviour, but told the court an underlying drug addiction was behind the reasoning of the offences.

“She was clearly under the influence of an intoxicating substance,” she said.

“She needs to get her drug addiction under control.”

Magistrate Keegan highlighted the distress the police officer would’ve experienced after being bitten.

“There’s an additional level of trauma to a victim when they have to undergo testing for the assault,” she said.

“Because police are doing a difficult and dangerous job they require protection and people who assault them in this manner should expect harsh sentences.

“With offences of violence, imprisonment is not a last resort, I take into account it’s a bite of a police officer, it’s a significant bite and I consider the only appropriate penalty is to be one of imprisonment.”

The woman started to cry loudly as the magistrate finalised the sentence.

She pleaded guilty to serious assault of a police officer by biting, obstructing police and possessing drugs.

Breuer was sentenced to 12 months’ jail with a parole release date of June 20, 2024 and sobbed loudly saying ‘tell my kids I love them’ to her parents in the courtroom.
