During a police search of his Toowoomba home, Kenneth Daniel Sinnamon had flicked a small bag of cannabis out of the window.

Unfortunately for him, the bag landed at the feet of a police officer standing outside.

Police had arrived at the home on another matter but after seeing drug utensils in the house the officers conducted a search of the property, police prosecutor Cameron Francis told Toowoomba Magistrates Court.

The search turned up scales, scissors and a pipe associated with cannabis use and the bag that the 42-year-old had thrown out of the window was found to contain 1.8g of cannabis, he said.

Sinnamon had been on two separate probation orders for similar offending at the time, the court heard.

He pleaded guilty to possessing dangerous drugs and drug related utensils.

Duty solicitor Ryan McCullough told the court his client was medicated for mental health issues including schizophrenia.

Though he had given up meth use, the father of five still had an issue with cannabis which he had found “was a difficult issue to crack”, he said.

Magistrate Graham Lee said probation orders had already been tried on Sinnamon and sentenced him to three months in jail but ordered the whole term be suspended for 12 months.
