Benjimin Brett Waters charged with interfering with dead man’s body

The 37-year-old is accused of tampering with a dead man’s body which was found in bushland on Toowoomba’s outskirts.

A 37-year-old man charged with interfering with a corpse relating to the alleged dumping of a 28-year-old Toowoomba man’s body has had his case mentioned in the city’s Magistrates Court.

Benjamin Brett Waters has been remanded in custody and was not required to be in Toowoomba Magistrates Court on Monday when his matters were mentioned.

He has been charged with “misconduct with a corpse by interfering” arising from the discovery of the body of 28-year-old Blake Riley found in bushland at Preston on January 7, 2021.

Waters has not yet been required to enter any plea to the charge.

No details of the police allegations have as yet been aired in open court.

Kelly-Ann May Sinclair, 36, of Glenvale, has also been charged with the offence and was released on bail late last year.

Both Ms Sinclair and Mr Watson were known to Mr Riley.

Mr Waters’ solicitor Joe McConnell, of McConnell Saldumbide Lawyers, told the court on Monday he was still awaiting the police brief of evidence.

However, police prosecutor Senior Constable Chris Willson told the court he had been advised that the brief was due for completion as early as this week.

Magistrate Clare Kelly therefore remanded Waters in custody and adjourned the case for mention back in the same court on February 6.
