Disability care swindler Sharon Maree Bailey back in court to appeal three-year prison sentence

A disability carer who was last month jailed for using a wheelchair-bound client’s credit cards to pay luxuries including Elton John concert tickets has appealed her sentence in court.

A Tasmanian disability carer who was last month jailed for fraudulently using a wheelchair-bound client’s credit cards to pay for luxuries including Gold Coast holidays and Elton John concert tickets has appeared back the Supreme Court to appeal her sentence.

Sharon Maree Bailey received a three-year term of imprisonment in April after pleading guilty to 86 counts of fraud relating to her employment at Hobart’s Community Based Support between 2016 and 2018.

In sentencing Bailey to serve at least 18 months before being eligible for parole, Acting Justice Shane Marshall said when the defendant had applied for the role at CBS, the mandatory police check document she submitted was missing pages that detailed her extensive history of dishonesty offences.

Soon after Bailey began a job that would not have otherwise been offered, she began using the bank account of an elderly complainant “as if it were her own”, Acting Justice Marshall said.

The court heard that the complainant had been initially reluctant to report the matter to police, as he did not believe anyone he knew — including Bailey — could be responsible for the $10,000 theft.

In sentencing, Acting Justice Marshall said he took into account Bailey’s guilty pleas, but said delays in the case could partly be attributed to her furnishing of false medical certificates to obtain adjournments in proceedings.

On Monday, Bailey appeared in court via video link from prison before Justice Tamara Jago, who adjourned the appeal case for a new direction hearing on 28 May.
