Alleged killer driver Elemer Dobak, 88, argues he has no case to answer over death by dangerous driving charge

An elderly driver charged over the death of a woman in Woodville last year will argue he has no case to answer, despite CCTV capturing footage of the crash, a court has heard.

An 88-year-old man charged with driving dangerously and causing the death of an elderly woman in Woodville last year has told a court he will argue there is no case to answer, despite prosecutors obtaining CCTV of the incident itself, a court has heard.

Family of Elemer Dobak, 88, assisted him into the Adelaide Magistrates Court on Wednesday morning where he was due to answer to a charge over the death of an 85-year-old woman last year.

Mr Dobak has been charged with causing death by dangerous driving after allegedly hitting Joan McCaskill, 85 from Rosewater, in Woodville on February 27, 2023.

Following the crash, she was taken to Royal Adelaide Hospital with life-threatening injuries but later sadly died.

Mr Dobak, of Findon, was taken to the Queen Elizabeth Hospital after the accident for a routine blood test and medical assessment.

Counsel for the 88-year-old on Wednesday told Magistrate Simon Smart his client would argue there is no case to answer.

“We’d seek to argue no case submissions,” his lawyer said.

He flagged that Mr Dobak would alternatively enter a not guilty plea on the next occasion if a case to answer was found.

Mr Dobak will return to court in May.

He declined to comment outside court.
