A jilted Warwick mother’s threat to release intimate images of her ex-partner can be revealed after the woman appeared in court.

The mother aged in her 40s – cannot be identified to protect the identity of the victim – appeared in Warwick Magistrates Court on July 15.

Police prosecutor Senior Constable Paul Condon told the court the woman and the victim had been in a relation for the better part of two decades and were separated at the time of offending.

On February 17 of this year, the woman took a photo of the man while showering without his consent, Constable Condon said.

“She was asked to delete the photo by the man,” the prosecutor said.

Only 10 days later, the man received a heinous text from his former partner containing the threat to distribute the photo to the man’s new partner.

“The text said ‘You’re either going to answer me … or I’ll let her know you’ve been f--king me for the past two months and send her the photo of you in my shower’,” Constable Condon detailed.

Police attended the woman’s address after the matter was reported, and she made admissions to officers of taking the photo and sending the text to the man.

The court was told the woman had no criminal history.

Defence lawyer Clare Hine told the court her client and the victim had separated a few years prior to the offending.

“She is a victim of domestic abuse while with the victim and was subjected to controlling behaviour by him,” Ms Hine said.

“She was scared to be late from work and was nervous about him getting home, she very much would describe her life as walking on eggshells.”

Ms Hine said the woman felt “extremely embarrassed” to be in court, reiterating it was an “empty threat” because she didn’t act on the threat and described the woman as “of good character”.

The woman pleaded guilty to one charge of threatening to release an intimate image or prohibited visual recording on Monday.

Magistrate Janice Crawford said she accepted that she likely wouldn’t have acted on the threat, and said “I don’t think you would have done that”.

“I’m told the relationship was an abusive one and it sounds like it probably was, that doesn’t excuse your behaviour but you have come before the court with remorse,” Ms Crawford said.

“I do think you demonstrating good character and I don’t think you’ll come back before the court.”

The woman was released on a recognisance order of $1000.

No conviction was recorded.
