Oscar Kinsey faces court on drug driving, driving under the influence, possessing dangerous drugs, failing to properly dispose of a needle and syringe

A magistrate had little sympathy for a Whitsunday man caught driving with multiple drugs in his system on multiple occasions.

A Whitsunday man has narrowly avoided jail after swearing at a magistrate while attempting to explain the drug use that landed him in court.

Oscar Kinsey, 29, clashed with Magistrate James Morton at Proserpine on Monday as he gave his take on drug driving, driving under the influence, failure to properly dispose of a needle and syringe, and possess dangerous drugs offences which occurred in Airlie Beach, Cannonvale and Jubilee Pocket between April 30 and May 15.

“I’d just broken up with my partner,” Kinsey began, reiterating comments from solicitor Elizabeth Smith who earlier stated Kinsey was a former addict who had been clean for four years but had “fallen off the wagon quite hard” after splitting with the mother of his one-year-old daughter.

“Who cares?” was the response from Mr Morton.

“Well, clearly I did,” Kinsey said.

“So, you turned to drugs? What’s the issue?” Mr Morton said.

“Well that’s clearly what I used to do - I was a f*cking eight-year addict,” Kinsey said.

“I beg your pardon?” Mr Morton said.

The heated exchange continued with Mr Morton telling Kinsey, “I’m not surprised you’re recently single.”

“Do you see your little child?” Mr Morton asked.

“Yes, mate,” Kinsey answered.

“Don’t call me ‘mate’ ‘cause I am not your mate. I wouldn’t have a mate like you,” Mr Morton said.

“That’s good, me either,” Kinsey said.

“I’m going to think about what I’m going to do with you but I’m considering sending you to jail,” Mr Morton said, ordering Kinsey to sit at the back of the courtroom and wait for his sentence.

Called back just prior to the court closing for the day, Kinsey was ordered to pay $1900 in fines, disqualified from driving for 14 months, and told “it would be a good idea to keep off the drugs”.

Convictions were recorded.
