A Whitsunday tradie and father of three “banged on doors and windows” after rocking up to a woman’s house for what turned out to be unwanted booty call.

The 44 year old claimed this was how he usually entered the property when he “came for sex”.

But instead Christopher William Hone landed himself with a trespassing charge when he entered a Cannonvale property, banging on the home’s doors and using a torch to look inside the windows about 11.30pm on November 2.

Police prosecutor Sergeant Emma Myors said the woman contacted police 22 days after the offence.

The court heard she told them she was “petrified, pretending to be asleep” when Hone came to her house.

Sergeant Myors said when police questioned the ship builder about the offence, he told them this was how “he usually gained entry to the property when attending for sex”.

The woman however told police officers she had not been in contact with Hone for “several months” when he came to her house, the court heard.

PD Law solicitor Elizabeth Smith said Hone had been in an “on and off” relationship with the woman but that it was “not unusual” for them to “go into each other’s house in the evening”.

Ms Smith added her client had left the property once he understood the woman was asleep.

She said her client admitted he had not called her before going to the house.

Hone pleaded guilty in Proserpine Magistrates Court to trespassing on a property.

Magistrate Michelle Howard said the “context” of their relationship “reduced” the level of criminality of the offence.

He was placed on a $300 three-month good behaviour bond and a conviction was not recorded.
