A Warwick man who flew into a violent rage in which he smashed glasses and a window while abusing staff members at a historic pub was just one of the residents recently sentenced in court for property-related offences.

Cassidy Robert Ryan was a patron at the Gowrie Road Hotel in Newtown on the evening of May 15, where he was playing the pokies before going outside for a cigarette.

Warwick Magistrates Court heard the 21-year-old returned to find the money he believed he had left in the machine was now missing, and demanded staff review security camera footage to determine who had stolen the cash.

Ryan became further enraged when employees came to the conclusion that he had simply lost all of his money himself, and began smashing several glasses on the bar and yelling at staff.

The Warwick man was then ordered to leave the pub and punched a window on his way out, shattering the glass completely.

He was soon found by police in a “highly agitated” state and with cuts all over his hands as a result of the violent outburst.

Duty lawyer Phillip Crook told the court that Ryan “basically (went) off the rails” after his ex-partner suffered a miscarriage earlier this year, and had since moved back to the Warwick area for better family support.

Magistrate Virginia Sturgess noted Ryan had been sentenced to jail with immediate parole only the previous week after pleading guilty to several traffic offences, warning the man again that he would need to break his criminal patterns or risk spending actual time behind bars.

Ryan pleaded guilty to one count each of wilful damage and committing a public nuisance offence on licensed premises.

He was sentenced to two months’ jail with immediate parole, which will run concurrently to his earlier two-month jail term.

A Warwick man fronted court after a night out at a popular Warwick pub turned violent.

Shane Anthony White was out with friends at The Criterion Hotel on the evening of July 23 last year when he and a couple of his mates were asked by staff to leave the premises.

Police prosecutor Steve de Lissa told Warwick Magistrates Court that the group left through the back entrance and walked around to the front of the pub, where White tapped a window to get the attention of one of his friends still inside.

The other man put his ear down to the window, at which point White punched and shattered it, leaving his friend with cuts to his face.

The court was told White had paid $1332 to the pub before appearing in court.

Duty lawyer Phillip Crook said his client acknowledged he was “very, very drunk” and foolish on the night, but should be commended for paying restitution of his own accord and going on to become the supervisor of a rehabilitation program.

White pleaded guilty to one count of wilful damage and was fined $450.

A Warwick man who left his brother’s front door dented and bloodstained and shattered a window during a violent outburst blamed mental health struggles for his offending.

An argument broke out on August 9 between Colin Daniel Kassulke and his brother over money the former owed his sibling, with the 44-year-old becoming agitated and going around to his brother’s home.

Police prosecutor Ken Wiggan said Kassulke banged loudly on the front door until his brother answered and became further enraged when he was refused entry, pushing the front screen door with his fist until he dented the material.

“He also punched the timber beside the door, and in doing so injured his hand and began bleeding, and left blood on the door and timber beside the door,” Sergeant Wiggan said.

Kassulke also smashed a pot plant next to the front door and then hurled a nearby paver through one of the front windows, which went through the glass and struck an antique timber table inside the house, leaving it with scratches and dents.

The Warwick man remained on his brother’s property for close to another hour before walking home on foot, after which he sent threatening texts to his sibling such as “I’m coming around to get you tonight”.

Kassulke pleaded guilty to two counts of wilful damage and one of using a carriage service to menace, harass, or cause offence.

He was fined $600.

Coaching another man through a destructive break-in over the phone was enough to earn Keith John Dyball additional time behind bars.

The convicted drug trafficker was busted via phone intercept telling the other man how to break into the Queenslander Hotel at Goondiwindi in October, 2019, telling his accomplice “this needed to be the night”.

Warwick District Court was told the other man cut a padlock and smashed several windows to gain entry to the building, then pulled down the security systems before unsuccessfully trying to remove the safe from the wall.

It was only weeks later that Dyball then stole $15,000 in cash from a person he was sourcing meth from as part of a drug trafficking ring at the time.

Dyball pleaded guilty to wilful damage, burglary, break and enter premises, and stealing.

He was sentenced to three years’ jail to be served alongside his existing term, and was eligible for parole as of June 7.

A Warwick man was placed on probation for 12 months after he destroyed the lock on his neighbour’s shed in a desperate effort to get his hands on their alcohol supply.

Eddie Matthew Sutherland entered the backyard of a Wood St home on March 22, forcing his way into the property’s back shed by breaking the lock on the door, and stole a carton of XXXX Gold beer and a pack of Vodka Cruisers from the fridge inside.

Warwick Magistrates Court heard the 49-year-old’s efforts left his victim $123.85 out of pocket.

Sutherland had landed himself in hot water only weeks earlier after he went to the Criterion Cellars store in Rose City Shoppingworld and selected a premix scotch can from the shelf, then consumed the drink while still in the shop.

Duty lawyer Clare Hine said the father of three had a significant alcohol problem that had spiralled to the point he would drink a 10-pack of spirits each day, but was now working with his doctor to break the habit.

Sutherland pleaded guilty to one count each of entering premises and committing an indictable offence and unauthorised dealing with shop goods.

He was also ordered to pay full restitution.

A parolee narrowly dodged spending further time behind jail after he ripped a door off a house and tried to escape from police through a neighbour’s yard.

Police were called to a Goondiwindi home on the evening of May 30, where they found the man had torn a security door from the house in which an ex-partner and children were living at the time.

The Warwick court heard the man fled on foot into the neighbouring backyard, but was soon caught and returned to custody a few days later, with his parole order suspended and release date set at July next year.

Defence lawyer Hamish Chapman said his client had a history of substance abuse and was struggling to cope with grief at the time, with this combination pushing the man to a “mental break” and needing to be taken to hospital for an emergency examination following his arrest.

The man pleaded guilty to one count each of wilful damage, trespass, and contravening a domestic violence order.

He was sentenced to three months’ jail, wholly suspended for 18 months.

NO CONVICTION RECORDED

Travis Mark Fitch was left with a hefty damages bill to pay after a big night out escalated to an aggressive drunken outburst.

The 24-year-old was at The Malt House just before 12.30am on March 27 when he was denied service at the bar due to his intoxicated state, and was asked to leave the premises entirely shortly afterwards.

Police prosecutor Steve de Lissa told the Warwick court that Fitch became frustrated and angry, first asking to speak to the pub’s security team before violently lashing out.

He said the Warwick man first hurled two gold concierge poles down the driveway at the front of the pub, and was later spotted by police punching a window on the neighbouring Andersens building.

Fitch was left owing $211 to The Malt House and another $712 to Andersens for repairs.

He pleaded guilty to two counts of wilful damage and was fined $500 on top of full restitution.

No conviction was recorded.

A young Warwick man who destroyed parts of a family’s property during a heated confrontation with his sister’s boyfriend walked away from court with a fine.

Seth James Mathie went to an Allora home on the evening of April 9, banging on the front door and demanding to speak with a teenage boy living at the house.

Warwick Magistrates Court heard Mathie repeatedly tried to get the 16-year-old to come outside, but the boy’s mother was able to keep her son from engaging in further conflict and the 20-year-old was forced to leave.

He kicked and bashed the front fence and access gate on his way out, causing $210 worth of damage to several panels along with the gate frame and supporting structures.

Mathie pleaded guilty to one count of wilful damage. He was fined $450 and ordered to pay full restitution.

No conviction was recorded.
