Colin Daniel Kassulke: Warwick man pummels door, hurls paver through window in furious rage at brother

‘I’m coming around to get you tonight’: The Warwick man threatened his brother after smashing a window and pummelling the front door to the point his hand was broken and bleeding.

A Warwick man who in a violent rage left his brother’s front door dented and bloodstained, a window smashed, and even made a threat on his sibling’s safety has faced court.

The dispute first broke out early in the evening of August 9 when Colin Daniel Kassulke and his brother got into an argument about money the former owed the other man.

Warwick Magistrates Court heard the 44-year-old became agitated and went around to his brother’s home, where he began banging loudly on the front door until the other man answered.

Police prosecutor Ken Wiggan said Kassulke became even more irate when his brother refused to let him in, and pushed in the front screen door with his fist until it caused a dent.

“He also punched the timber beside the door and in doing so injured his hand and began bleeding, and left blood on the door and timber beside the door,” Sergeant Wiggan said.

Kassulke also smashed a pot plant next to the front door, before picking up a paver from the edge of a nearby garden bed and hurling it through one of the front windows.

“The paver continued through the house after smashing the glass and hit an antique timber table located inside the window, causing scratches and dents to it,” Sergeant Wiggan said.

The Warwick court was told Kassulke remained on his brother’s property for close to another hour before walking home on foot, after which he sent more texts to his sibling making threats such as “I’m coming around to get you tonight”.

After his brother reported the destruction to police the next morning, Kassulke took responsibility for the damage and said he only became enraged as he was “sick of being treated badly by people”.

No quotes for the repairs to the rental property were submitted to the court.

Duty lawyer Phillip Crook said his client was on a disability pension due to schizophrenia and broke his hand during the outburst at his brother’s home, meaning he had to go to the hospital later that night for treatment.

“The threat was very low-key. His brother couldn’t have been too worried, as he didn’t call police until the next day,” Mr Crook said.

Acting magistrate Rob Turra acknowledged Kassulke’s mental health likely played a role in his offending, but could not justify his violent conduct.

“No one was hurt – he was right to not open the door, though. You were most certainly not in a good mood,” Mr Turra said.

Kassulke pleaded guilty to two counts of wilful damage and one of using a carriage service to menace, harass, or cause offence.

He was fined $600.
