A Southern Downs community institution is now facing a hefty compensation claim after a former employee was allegedly seriously injured while at work.
A former registered nurse at aged care facility Killarney Memorial Aged Care is suing the nursing home for damages and breaching duty of care over an incident at the facility in 2020.
Warwick Daily News has obtained documents filed in the Toowoomba Supreme Court which detail the allegations behind the more than $1.37m claim.
According to the claim, the former RN suffered a serious back injury while assisting a resident with known mobility issues.
It is alleged the nursing home failed in its duty of care by not providing the appropriate aides or devices to safely move the resident which could’ve prevented the employee from having to perform the procedure manually.
The claim states the former employee has suffered a significant long-term economic loss and disability as a result of the workplace injury.
For damages to the former employees earning capacity the claim estimates a lifetime income loss of more than $1m.
It’s further estimated the former employee has suffered a past earning loss of $83,000, and will incur future medical and associated expenses of $20,000 as well as a number of other financial losses.
Killarney Memorial Aged Care have yet to file their defence.
