Teen stabs mother’s partner 35 times on Sunshine Coast, claims self defence

A court heard a juvenile screamed “you f*****g dog” over and over as he stabbed his mother’s partner 35 times – but the teen says it was self defence.

A juvenile screamed “you f*****g dog” over and over as he stabbed his mother’s partner 35 times a court has heard.

But the teenager, who was 16 at the time, says he was acting in self-defence and denied launching the fatal attack in response to the man offering his younger brother a bong.

The now 18-year-old, who can’t be identified, has pleaded not guilty to murder on September 7, 2022 at his home in Baringa on the Sunshine Coast.

The boy has told a Supreme Court jury that on the fatal night the two had been drinking together in the laundry when the man started talking about “drugs and violent stuff”.

This apparently included talk about having set someone on fire and bashing someone he met at a pub.

The defendant said he was scared to the point of crying and the man called him a “f*****g pussy”.

The youth said the man wanted his brother to have some cannabis but the defendant snatched the bong out of the younger child’s hand saying he did not want the boy to become a drug addict.

The teenager said he went to the bathroom to get away from the situation and the man followed him telling him to hurry up.

He said he next went to the kitchen and was followed by the man who was looking for his keys saying under his breath “I’ll take you for a ride”.

“I was frozen,” he told the jury on Monday.

“I remember he was saying to me ‘I know you want to f*****g do something’ and I was saying ‘no’.”

The teen claimed the man grabbed him by the shirt and walked him backwards as he pleaded for him to stop.

He said he pulled out a knife to get the man to stop but he kept walking towards him and tried to reach for the weapon.

“I didn’t know what to do … I was scared,” he said.

“Thats when I started stabbing him.

“I remember just screaming ‘you f*****g dog’ over and over again’.”

When the man fell to the ground the teenager said he went into shock and began running around the house, headbutting a wall.

When his mother emerged the boy told her the man was going to kill him, the court heard.

“I thought that at the time,” he said.

Defence barrister Charlotte Smith asked whether he was intending to kill or seriously harm the man.

“No, I just wanted it to stop,” he said.

“I thought he was going to hurt me.”

Crown prosecutor Rebecca Marks suggested the teenager was making up the story as he went along and he was in fact the aggressor that night.

“You weren’t defending yourself that night,” she said.

“I was,” he responded.

“And in fact, you were attacking (him) because you wanted to kill him,” Ms Marks continued.

“No,” the defendant said.

Ms Marks suggested the teenager had become enraged by the man encouraging his younger brother to have a bong.

“You stewed on that didn’t you, and became angrier and angrier. You were also angry with him because you felt he didn’t love you,” she said.

“No,” the teenager responded.

“The reality is you felt he deserved what happened to him that night, and that’s what you told your mother, didn’t you?

“I said that because I didn’t do it for no reason.”

He denied pursuing the man, “stabbing and slashing him in an utter rage”.

After the cross-examination the defence closed its case.

The trial adjourned until after lunch.
