Orrick Bain pleads guilty to cowardly skateboard robbery of man at Baringa

Troubling footage has been played in court of a Noosa teen bashing a man with a skateboard during a cowardly robbery with his mates where they demanded he take off his clothes and chain.

A Noosaville teen will not go to jail for his role in a cowardly three on one bashing where he wielded a skateboard while demanding the victim take his clothes off.

Disturbing footage of the park bashing was played to Maroochydore District Court on Monday after Orrick Walter Bain, 19, pleaded guilty to armed robbery in company.

The apprentice and two others lured the victim to a Baringa football field on July 20, 2023 after the court heard the complainant had reportedly pulled a knife on one of Bain’s co-accused’s mates in the weeks beforehand.

Judge Michael Byrne said while walking to the park, the victim showed the decorative knife to Bain. The court was told the victim did this in a “collegiate” and “friendly” way with no menace.

Crown prosecutor Erica Zammit then played video taken by one of the group to the court, with several of Bain’s supporters watching in the public gallery.

“Please, okay ... okay, please,” the victim begged.

“Take off the shoes c--t, take ‘em off ... f---ing dog,” can be heard in the video.

“What’s in your pockets c--t … take off your pants c--t.

“F---ing dog … give me that chain boy.

“Pull knives c--t, lesson learned.”

In the video Bain can be seen using a skateboard to savagely beat the victim three times after the co-accused started the bashing.

Ms Zammit said Bain’s first strike connected with the victim as he lay on the ground. The 19-year-old then whacked the victim in the head with his weapon in a downward motion before a final horizontal swing.

The prosecutor said the group, which consisted of Bain and two other boys, demanded the victim take off his clothes and empty his pockets.

They left the scene with the man’s wallet, shoes, shoulder bag, knife, jumper, sunglasses and chain.

Ms Zammit said the victim suffered a 6cm cut to his scalp which exposed the bone which required staples. The court heard the victim also suffered bruising to his cheek, forearms and wrist.

She told the court one of the other boy’s in the attack, who was also 18 at the time, was jailed for two and a half years, suspended after 305 days in pre sentence custody.

The court heard he was sentenced for the robbery along with other offences.

Defence barrister Mark Dixon said the other boy who received this jail sentence was the “architect” of the violent robbery with Bain being “led” by a more experienced offender. He however said there was no escaping that Bain was an active participant.

Mr Dixon said the Noosaville teen was homeless and couch surfing at the time. Bain started living with his co-accused and fell into criminal behaviour.

The barrister conceded it was “phenomenally stupid and dangerous course of behaviour” by Bain but said the teenager was deeply remorseful, with the robbery being out of character.

Since being charged, the court heard Bain was engaging with a counsellor and started an apprenticeship.

Judge Byrne said it was clear Bain had “lost his way” but was prepared to give him one last chance to turn his life around.

Bain was placed on a three year probation order and must perform 180 hours’ community service. He was also ordered to pay $2000 in compensation to the victim.

No conviction was recorded.
