David Scott Jones in court for throwing vulgar comment at neighbour

A man’s ‘disgusting’ comment to his former neighbour, who he has previously assaulted, has landed him in court again.

A middle-aged man was kicked out of a Sunshine Coast public housing complex when he made a vulgar comment to a neighbour who he had previously assaulted.

David Scott Jones pleaded guilty in the Maroochydore Magistrates Court on August 7 to one count of being a public nuisance.

Police prosecutor Mark Burrell told the court Jones had approached the victim in the complex and the woman began recording after he started speaking to her.

The court heard as the woman retreated, Jones had uttered a vulgar comment and “moaned.”

“Are you going to go masturbate?” he had asked her.

Defence lawyer Michael Robinson said his client was kicked out of the housing complex in Tewantin and now rents a converted garage, costing him more weekly than what he previously paid in a fortnight.

He told the court a psychological report stated the 59-year-old pensioner may have suffered a brain injury in his youth and possible mental health issues that have all been undiagnosed.

Mr Robinson highlighted the incident did not involve any violence or threats and Jones had not approached the victim closely.

Jones gave his lawyer a fist bump under the table after he concluded his submissions.

Magistrate Chris Callaghan told the court Jones was previously convicted of common assault and public nuisance offences against the same woman.

Mr Callaghan labelled his latest comment “disgusting”.

He noted Jones had other convictions of public nuisance offences on his criminal record.

“Your behaviour is appalling,” Mr Callaghan said.

He sentenced Jones to three months’ imprisonment wholly suspended for three months.
