A court has heard how a man accused of attempting to murder an innocent cyclist in a Sunshine Coast suburb tried to get help for his mental health beforehand.

A Noosaville man accused of attempting to murder a cyclist on the Sunshine Coast has been granted bail after nearly a year spent in presentence custody.

Kyle John Heaney, 24, faces charges of attempted murder, three counts of dangerous operation of a vehicle, committing a public nuisance, failing to remain at the incident and render assistance as a driver and obstructing a police officer.

It is alleged Mr Heaney was driving along Frizzo Rd on September 30, 2021, and allegedly struck semi-professional cyclist Daniel Di Domenico.

Mr Di Domenico’s riding colleague was also allegedly hit by Mr Heaney in a separate incident along Nambour Connection Rd, Nambour, leaving the victim with a serious head injury.

Police will allege Mr Heaney was later involved in a third crash at Burnside.

Defence lawyer Luke Bull applied for bail on Mr Heaney’s behalf in Maroochydore Magistrates Court on August 30, that was opposed by prosecutors due to a risk of him reoffending.

Mr Bull said his client could be put on bail conditions including that he abstain from drugs or alcohol and have a treatment plan for his mental health.

Mr Bull told the court Mr Heaney had been diagnosed with schizophrenia and that on the day leading up to the alleged incident he surrendered himself at a hospital.

He was later discharged from the hospital by staff, which Magistrate Matthew McLaughlin said was “tragic”.

“I hope there’s some feedback given ... they probably need to review their methods of assessment,” Mr McLaughlin said.

Mr Bull said if his client wasn’t granted bail he could be at great risk of spending too much time in custody.

Prosecutor James Allen told the court Mr Heaney was found to have had marijuana in his system, approximately 0.006 milligrams a litre, but no alcohol or methamphetamine at the time of the alleged offences.

The 24-year-old was also not taking his medication for his schizophrenia.

The court heard even though Mr Heaney was found to be of unsound mind, he may not have a defence if he was in fact intoxicated at the time.

Magistrate McLaughlin granted Mr Heaney bail and added an additional condition to the bail that he must comply with any mental health treatment plans and medication required.

Mr Heaney will next appear before Maroochydore Magistrates Court for committal mention on December 16, 2022.
