Fleur Annabelle Iris Aveline pleads guilty to common assault after bashing ex girlfriend

A Sunshine Coast university student previously convicted of drunk driving has faced court once again while on a “break-up bender” – this time for aggressively chasing and bashing her ex-girlfriend.

Fleur Annabelle Iris Aveline, 22, faced Maroochydore Magistrates Court on Monday, October 14, charged with bashing her ex-girlfriend on May 10.

She was before court in July this year for lying to police after she drunkenly crashed into a garden bed and tried to drive away before her keys were ripped from the ignition.

The court was told she was more than four times the legal blood alcohol limit when she was arrested following the single-vehicle smash on July 6 at Palmview.

Aveline was fined $1200 and disqualified from driving for one year. A traffic conviction was recorded.

In July, the court heard from duty lawyer Rachel Holland who said Aveline was on a “bender” following a break-up.

Now, the court has heard the messy details of the break-up and how Aveline “aggressively” bashed her ex-girlfriend.

Police prosecutor Mel Pyke told the court the victim, Aveline’s ex-girlfriend of 11 months, had stayed the night at Aveline’s Sippy Downs home on May 9. The couple was working on university assignments.

The court heard Aveline said “upsetting” things to the victim. Because of this the victim broke up with Aveline, while at her place.

On May 10, about 5.30am, the victim attempted to escape by climbing out of Aveline’s bedroom window. Ms Pyke told the court she was physically dragged backwards by Aveline – which was the start of the bashing.

Aveline then tackled her onto her bed. The victim was able to push her away, grab her iPad and vape, and run out of the front door and onto the front lawn.

The court was told Aveline then grabbed her ex-girlfriend causing her to fall to the ground.

“The defendant then punched the victim to the back of her head,” Ms Pyke told the court.

The victim curled up into the foetal position before Aveline punched her again to the side of the head and punched her arms.

“The victim was able to flee from the defendant and ran down the road,” Ms Pyke said.

Aveline chased her, grabbed her hair from behind, then got in front of the victim, and ripped her shirt up.

“And (she) aggressively grabbed the victim’s nipples,” Ms Pyke said.

She tried to run away again but Aveline hunted her down and dragged her onto the ground. Aveline then punched her in the back of the head (again) and tried to rub mud into her face.

The victim tried to run away but Aveline grabbed her and she fell into a gutter. Aveline then punched her in the face, jaw, and the back of her head.

The court was told the victim held up her iPad and said she’d record the assault.

The pair was then approached by a woman and the victim asked her to phone police for help.

The witness told police she saw Aveline sitting on the victim and provided a formal statement.

The victim then ran away again but Aveline caught her, pinned her to the ground, and her iPad was damaged.

She once again tried to escape but Aveline caught her and tackled her to the ground once more.

“Two male motorists stopped to help the victim,” Ms Pyke said.

“One of the males told the defendant to leave and the defendant ran off.”

On June 26, police were at Aveline’s Sippy Downs home in relation to the assault.

Initially Aveline denied the assault to police. Aveline told police the victim was not allowed in her mother’s investment home (where she lived with housemates) so she had been snuck in.

Aveline’s lawyer Michael Robinson asked for a conviction to not be recorded because Aveline dreamt of working as a registered psychologist in Queensland.

Mr Robinson told the court Aveline moved to Australia from France when she was nine, in 2007.

Her mother was a doctor who bought and sold investment properties.

He said Aveline was not working but was getting about $700 a fortnight from Centrelink payments, and Aveline had been depressed and suicidal since she was 12.

Her mother, being a doctor, put her on medication for the depression but when Aveline was 17 she started counselling and said she found it to be more effective.

The court heard Aveline had previously worked as a chef and in aged care. She was currently not paying her mother any rent.

Magistrate Chris Callaghan told Aveline it was a very “serious assault”.

“She wanted to get away from you and you chased her down,” he told the court.

He said Aveline was lucky her victim was not more badly injured and called her out for once again lying to police.

He sentenced Aveline to a 12-month probation order and did not record a conviction.

“I think probation will help you,” he said.
