Developer set to take Sunshine Coast Council to court over waste facility plans

The developer behind plans for a waste facility in Yandina, blocked by the Sunshine Coast Council due to environmental concerns, has begun court proceedings to overturn the decision.

The developer behind plans for a waste facility in Yandina, blocked by the Sunshine Coast Council due to environmental concerns, has begun court proceedings to overturn the refusal.

Plans to establish a waste facility at 58 Ninderry Rd at Yandina were first submitted to the Sunshine Coast Council by developer, Poolsea Pty Ltd in November 2022.

However, after months of back-and-forth between the council and the developer regarding the environmental impacts, the application was ultimately rejected last month.

The 2.79ha property, which is bordered by the Bruce hwy on the west and the Maroochy River on the eastern side, currently holds a single home and an unauthorised scrap metal yard.

The planning report stated the facility would receive scrap materials from construction sites and demolitions, storing them for resale.

“Trucks will be entering and leaving the facility on a regular basis as well as being stored onsite when they are not in use. The site will operate between 6am – 6pm,” the planning report stated.

According to the Planning and Environment Court documents, the council refused the development due to flooding concerns, which they claim were not mitigated by the plans.

“(Refused) because the safety of people and the risk of harm to the property and the natural environment from flood inundation is not minimised,” the court documents stated.

The council’s decision also outlined proposed “major earthworks” as another reason for the refusal, stating they would alter the local floodplain.

“The application has not demonstrated that the proposed bund/levee and loss of floodplain storage will not have an adverse impact on the hydrologic regime of the North Maroochy River,” the decision stated.

The developer argues, in the court documents, the facility would offer employment opportunities to the region as well as a “needed’ recycling site.
