A concreting business owner and a mother have found themselves in court after a confrontation about social media posts quickly turned violent.
Brock Jeffrey Winston, now 34, and Jessica Taylor Graham-Aspinall, now 28, were sentenced in Maroochydore District Court on September 19, 2022.
Graham-Aspinall was given two years’ probation after pleading guilty to burglary with violence and in company, two counts of common assault and robbery, while Winston was given 12 months in prison with immediate parole after pleading guilty to robbery and common assault.
Crown prosecutor Elle Bolam said on March 25, 2021, someone changed the 19-year-old complainant’s Instagram profile picture to a “feral” photo of her and made her workplace at an adult entertainment venue public.
The court heard the complainant believed Graham-Aspinall’s 16-year-old half sister was responsible and later that day the complainant uploaded Facebook and Instagram photos of the half sister using cocaine.
When asked to delete the posts she did so, but also uploaded another post that said the half sister deserved it.
Ms Bolam told the court Winston then called the complainant and said she was a “slummy little rat” before belittling her about her job.
That afternoon, at 5.30pm, Winston, Graham-Aspinall and their co-offender Demi Elizabeth Splatt, arrived at the complainant’s home in Currimundi.
Graham-Aspinall and Splatt asked to talk to the complainant but she tried to shut the door so they barged inside, the court heard.
Graham-Aspinall said something like “get her” before Splatt grabbed the complainant’s hair and punched her face repeatedly.
Ms Bolam said Graham-Aspinall was yelling that the complainant had “killed” her half sister as the 16-year-old had run away and couldn’t be located at the time.
Winston then became involved and put his hand over the complainant’s mouth while she was dragged by Splatt.
One of the women handed Winston the complainant’s phone and he pocketed it while the complainant was punched and kneed in the genitals by Graham-Aspinall.
During the altercation, Graham-Aspinall threatened the complainant with a crowbar.
Graham-Aspinall’s defence barrister said she was a mother and it was a “highly emotional” time for her as the offending was out of character.
“There were concerns that day that the 16-year-old girl (the half sister) was going to take her life,” the barrister said.
Winton’s defence barrister Nicholas Brown said his client didn’t do any of the physical acts and had a concreting business in Caboolture where he employed three staff members.
Mr Brown said Winston used to be a professional motorcycle rider and character references were tendered for both defendants who were remorseful.
Convictions were recorded for Winston but not for Graham-Aspinall.
