A man who pleaded guilty to possessing thousands of disturbing child abuse files, including a video depicting the rape of a 9-month-old baby, has been busted using online sites popular with children.

Robert Graham Milliken was given a two-years suspended jail in 2016 for possessing child exploitation material.

Following his conviction, the now 38-year-old was declared a reportable offender Crown prosecutor Alysha Ballantyne told the Kingaroy District Court on Tuesday.

The conditions require Milliken to report the accounts to police within seven days, which he failed to do.

Milliken was first into custody for the initial offences on March 19, 2015 after police raided his parents’ home, where he was living at the time.

The search uncovered a laptop, USB stick, two iPhones and an iPad with 4149 examples of child exploitation material.

The most serious video featured an adult man performing sexual acts on a nine-month-old baby boy, who was tied to a bench and urinated and defecated on.

Crown prosecutor Jodie Crane had told the Townsville Court the child could be seen crying and attempting to “crawl away from the adult” in the “horrific” video.

Milliken was returned to custody following a compliance check by police on March 28 this year.

Police discovered a PlayStation Live account, a Nintendo Switch Live account and a WhatsApp account, which he failed to disclose to police.

Ms Ballantyne said the offences were serious as the conditions he breached were designed to “protect children, reduce the likelihood of an offender reoffending, and facilitate the investigation and prosecution of any future offences the offender may commit”.

Defence lawyer Robert Glenday said his client suffers fragile x syndrome, an intellectual impairment that affected decision-making processes.

Milliken pleaded guilty to breaching his suspended sentence.

Judge David Kent said it would be unjust to activate the whole suspended sentence, but increased the operational period of his suspended sentence by three months.
