Cherbourg man in court for aggravated domestic violence offences

A Murgon court has been told a man with multiple ‘aggravated’ domestic violence convictions turned up at his ex partner’s home covered in blood after headbutting a street sign several times.

A 45-year-old Cherbourg man who threatened to kill his ex-partner pleaded guilty in Murgon Magistrates Court on Tuesday to contravening an order that required him to stay at least 100m away from the victim.

The man, who can’t be named for legal reasons, appeared via video link from Maryborough Correctional Facility and pleaded guilty to three charges of contravening a domestic violence order, aggravated offences.

Police prosecutor Pepe Gangemi said on a date between February 22, 2024, and March 3, 2024, the man was at the victim’s house when he began threatening her.

“The defendant was drunk, he threatened the aggrieved and used the words, ‘if you leave me I will kill you’,” Sergeant Gangemi said.

The court heard around midday on April 4, 2024, the victim was at home in her garage when she heard the man screaming down the street.

“She could hear him swearing … she saw the defendant headbutt the signpost pole three or four times.” Sgt Gangemi said.

The court heard the man had blood on him and approached the driveway before the victim cleaned him off with a garden hose.

Sgt Gangemi said six weeks later, on May 15, the man walked up the victim’s driveway.

“She told him to leave … he used words to the effect of ‘you mother f---er’,” Sgt Gangemi said.

The man eventually left while still verbally abusing the victim, the court was told.

The court heard he had been convicted of similar offences and was on parole at the time of these incidents.

The man’s lawyer, Mark Oliver, said the defendant was an alcoholic and had been for years.

“He verbalises but rarely carries out his threats,” Mr Oliver said.

Mr Oliver said once the man was released, he would be staying with his new partner.

“She has knowledge of these offences and she’s quite happy, when he is released, that he returns to her address,” Mr Oliver said.

Magistrate Andrew Sinclair noted the defendant had “many convictions” for domestic violence, usually while drinking.

“You would be best advised to cease drinking alcohol altogether or not to live in Cherbourg,” Mr Sinclair said.

The man was sentenced to six months imprisonment for the first count and three months each for the other two charges, to be served concurrently.

With 75 days already served, he will be released on parole on August 23.

After his release, he will have three months on parole and then a further nine months on a suspended sentence.

Convictions were recorded.
