A baker has been banned from a popular Central Queensland nightspot after he unleashed a flurry of punches on another man at the venue.
Trevor Rex Sayer was at The Strand Hotel, Yeppoon, last month when about 10.45pm he approached the other man and said “let’s go outside.”
The other man believed Sayer wanted to fight him.
The pair had a brief conversation before Sayer, using both hands, pushed the man in the chest.
Sayer then punched him four to five times, connecting with his jaw and left temple, causing immediate pain.
Security intervened and escorted Sayer out of the hotel.
Sayer, 24, accepted this version of events in Yeppoon Magistrates Court on July 4 where he pleaded guilty to assault in public while intoxicated.
Police prosecutor Mirren Smith said Sayer, when questioned by police, admitted to consuming “quite a lot of alcohol” prior to the incident and said he felt like the victim was being intimidating towards his friend.
“(Sayer) said that he wasn’t injured in the fight and the victim didn’t punch him back,” Ms Smith said.
Sayer had no criminal history and the prosecution sought a banning order for The Strand Hotel.
Solicitor Oscar Millroy said prior to the assault there was “ongoing tension” between Sayer and the victim.
“However, he (Sayer) knows he shouldn’t have acted the way he acted,” Mr Millroy said.
“He instructs he was extremely intoxicated... he demonstrated remorse.”
Magistrate Grace Kahlert ordered Sayer perform 40 hours of unpaid community service and pay $200 compensation to the victim.
She also banned him from The Strand Hotel for 12 months.
No conviction was recorded.
