A gold mask, a rifle not seen before by a long-time Rockhampton detective and a mysterious waxy substance are part of the evidence police gathered when investigating shots fired at a house.

This information was revealed during the cross-examination of Rockhampton Criminal Investigation Branch Detective Sergeant Jason Milner in relation to charges laid for one of three men accused of the crime – Timothy Clement Beazley.

Police allege Mr Beazley was involved in an early morning shooting in March 2022.

During the cross-examination committal hearing on October 31 in Rockhampton Magistrates Court, two co-accused were named – Dieter Dean Stephens from Mackay and recently deceased prisoner Lui Matalio Dylan Tiaaleaiga.

Tiaaleaiga, 30, an Emmaus College graduate and former Newcastle Knights player was pronounced deceased in his Maryborough Correctional Centre cell in August.

He once escaped custody while being treated at Rockhampton Hospital.

Police will allege shots were fired about 6.30am on March 16, 2022, at a house in Armstrong Street, Berserker.

Sergeant Milner said CCTV footage seized from the scene allegedly showed Mr Beazely was wearing a black shirt with a coloured motif on it.

“There was one distinctive larger male who got out of the car and two smaller males,” he said.

“The larger male was a lot wider than the other two.”

Sergeant Milner said he alleged Mr Beazely was one of the smaller two men who had his face covered.

He said a gold mask with something across the forehead located at Tiaaleaiga’s Mackay motel room on March 26 looked similar to one seen in the CCTV footage.

Police also seized a balaclava with Mr Beazely’s DNA on it, a Stoeger M300 Sergeant Milner said he had not seen in his career, phones, a sawn-off shotgun with distinctive blue tape around the stock, and ammunition police believe are linked to the house shooting.

Sergeant Milner said the Stoeger M3000 matched the type of weapon being carried and the photograph retrieved from Mr Beazely’s phone, once it was downloaded.

He said the balaclava was found at Mr Beazley’s Park Avenue residence eight days after the alleged shooting.

The court heard police also located a waxy substance at the scene and on a cartridge in a vehicle intercepted by police in Gladstone on March 22, 2022, in which Mr Beazely was occupying.

Sgt Milner said the chemical analysis could not conclude if the two waxy substances were the same material or if they came from the same source, just that it had similar chemical makeup.

“It’s certainly not something usually found in shotgun shells,” he said.

Sgt Milner said it was his understanding from the report that the marks on the shotgun shells found at the crime scene were “similar” to those tested using the firearm Mr Beazely was found possessing.

Mr Beazely’s charges are one count each of acts with intent to cause grievous bodily harm, unlawful use of a motor vehicle used in an indictable offence – namely acts to cause grievous bodily harm – and possessing of a category H weapon.

He has not entered pleas.

Mr Stephens has other matters which are listed for mention in Mackay Magistrates Court in January.

He has the same charges as Mr Beazely in Rockhampton Magistrates Court.

Mr Beazley was jailed in the Rockhampton Supreme Court in May 2023 for a number of offences and sentenced to eight-years prison, cumulative on a five-year prison term handed down in 2020 and his parole eligibility date was set for March 14, 2024.
