A Central Queensland man assaulted his housemate after taking issue with her dogs, a court has heard.

A Central Queensland man who assaulted his housemate was triggered by her dogs urinating inside their home, a court has heard.

Simon Grady Best, 42, pleaded guilty in Yeppoon Magistrates Court to assault of a person over 60.

The court heard that on the afternoon of October 15 last year, Best got into an argument with his 68-year-old housemate after confronting her about her dogs urinating inside the Zilzie house they shared.

Police prosecutor Mirren Smith said Best “continually berated” the woman about her dogs during the argument

Ms Smith said the woman then followed Best to his bedroom and she pushed the slightly-ajar door open to continue the argument.

“It was at this point that (Best) has pushed (the woman) in the chest, causing her to lose balance and fall backwards against the wall,” Ms Smith said.

“(The woman) is an elderly woman who has undergone hip and knee replacement surgery and she has struggled to get back to her feet after the assault.”

Ms Smith said the woman sustained bruising to her left breast and elbow, and her right wrist during the assault.

“(She) then attended the hospital two days later to have her injuries assessed.”

The court heard Best’s criminal history contained “predominantly minor drug offending” and he had no prior assault offending.

Solicitor Oscar Millroy said Best had worked as a carpenter for most of his adult life and it (the incident) “certainly wasn’t a one-sided onslaught by Mr Best”.

“An argument arose from (the woman’s) dogs urinating inside the house - it understandably caused Mr Best to become agitated,” Mr Millroy said.

“The push has occurred, he shut the door, and on my instructions, he has attempted to assist (the woman) in getting back to her feet.

“He instructs he did not have any knowledge of (the woman’s) hip and knee replacements.”

Magistrate Philippa Beckinsale politely asked why the pair were living together.

Mr Millroy replied: “It was essentially a shared living arrangement - they were tenants of his... and they’d been behind in rent.

“She (the woman) has since moved out.”

During sentencing, Ms Beckinsale said Best was “very, very lucky” the woman had not suffered more serious injuries or fallen and hit her head.

She fined him $900 and a conviction was recorded.
