Daniel Tully sentenced for McDonald’s Gladstone incident

A man whose ‘disgusting’ act in a Central Queensland McDonald’s drive-thru was captured on camera, then went inside the store and assaulted a manager.

A man whose “disgusting” act in a Central Queensland McDonald’s drive-thru preceded him assaulting a store manager, has been sentenced.

Daniel Neville Tully, 31, pleaded guilty in Gladstone Magistrates Court to supplying dangerous drugs, common assault, trespass and two counts of wilful damage.

The court heard that last July, Tully stabbed a car tyre twice with a knife after an argument with a man - the first wilful damage offence.

Police executed a search warrant at Tully’s residence and on his phone found a Facebook Messenger conversation where Tully offered to sell some of his medicinal cannabis to another person.

In one of Tully’s messages to that person, he said: “I’ve got my medical here if you want half a gram (for) $15... because it’s expensive - one cone and you’re set for hours though... this stuff will impress you bro, the best I’ve ever had.”

The court heard Tully made the sale and couldn’t see the difference between doing that and giving a friend a lift in a car.

Then on August 17, Tully drove through the McDonald’s Gladstone drive-thru on Glenlyon Street.

There, he began arguing with a cashier at the window about his order.

The court heard the cashier closed the window on Tully, who then spat on it.

It was told Tully then drove to the front of the store and went inside, walking up to the front counter where he complained to staff.

A manager, who had seen on CCTV Tully spitting on the window, continuously told Tully to leave the premises but he refused to.

The manager then called Triple-0 and showed Tully that he was calling the emergency line.

The court heard Tully then tried to hit the phone out of the manager’s hand - hitting him on the shoulder in the process.

The manager attempted to remove Tully from the store and Tully shoved him.

At the front of the store, Tully continued to argue and refused to leave.

The court heard Tully had a five-page criminal history which was “littered” with drug offences.

It also included a previous supplying dangerous drugs offence, as well as a threatening violence offence, and a common assault in public while adversely affected offence.

Solicitor Stephen White said Tully came from a very close-knit family and his mother was in court to support him.

Mr White said Tully’s mental condition (supporting documents tendered) had been exacerbated by a severe right hand injury where four of his fingers were severed.

“He literally fell onto a kitchen knife and the knife effectively guillotined (his) fingers,” Mr White said.

“And that’s his dominant hand.”

Mr White submitted Tully would benefit from a probation order.

During sentencing, Magistrate Mary Buchanan said spitting on the McDonald’s drive-through window was “unpleasant and disgusting.”

She referred to Tully’s criminal history and these latest offences, saying “it seems that your conflict resolution isn’t very good and I take it that’s probably in context of issues you’ve got with your wrist and mental health over the years.”

She placed Tully on 18 months’ probation and ordered he pay $50 restitution for the damaged tyre.

Convictions were recorded.
