Scott Ryan Tyack sentenced for possessing drugs at Emerald

When Central Queensland police were called to the scene of a shirtless teenager lying on the road late at night, it quickly became apparent why he was there.

A court has heard the reason police found a shirtless teenager lying on a road late at night in Central Queensland.

Scott Ryan Tyack, 19, pleaded guilty in Rockhampton Magistrates Court to charges including possessing dangerous drugs.

Police prosecutor Senior Constable Sarah Rowe said about 11.18pm on September 29 last year, police in Emerald received a report a male was “on the road” and appeared to be affected by drugs.

“Police attended at 11.20pm and observed (Tyack) lying on the road with no shirt on,” Snr Const Rowe said.

“His movements were erratic, he was kicking and lashing out, eyes were rolled back and his speech was slurred.”

The court heard Queensland Ambulance Service attended.

It was told just 1.5m from Tyack, police found a clip-seal bag on the road which contained 2.2g of cannabis.

“The only other person present (at the scene) was the informant, standing on the grass outside the property,” Snr Const Rowe said.

The prosecutor said QAS sedated Tyack and took him to hospital.

Snr Const Rowe said Tyack, during a later interview with police, told them he had been drinking with a friend on the night of the incident and he could not recall what he was drinking but he “was blind drunk.”

“(Tyack) stated he had three... bags on (him) - each contained 1.5g of cannabis.

“(He) doesn’t recall what he did with the bags or if he combined the bags together at some point.

“(He) further stated that the clip-seal bag containing 2.2g of cannabis belonging to him.”

Snr Const Rowe said Tyack had a “quite serious” criminal history and the court heard he had previously been sentenced in Mackay earlier this year for dangerous operation of a vehicle and evasion offences.

Solicitor Samantha Legrady said Tyack had limited education, was hopeful of gaining employment, and he had the support of his grandmother at Emerald.

During sentencing on August 27, Magistrate Philippa Beckinsale fined Tyack $800 and convictions were recorded.
