A Central Queensland father has been sentenced in court after he grabbed his partner by the throat and pushed her into a lounge while she was trying to break up with him.

The defendant, who cannot be identified for legal reasons, pleaded guilty in Rockhampton Magistrates Court on January 20 to one count each of contravening a domestic violence order and producing dangerous drugs.

The court heard there was a domestic violence order in place with mandatory conditions.

Police prosecutor David Longhurst said the defendant and victim were at an address in Gracemere on September 4, 2022 at 9pm when the victim told the defendant she no longer wished to continue the relationship and that she wanted him to leave.

Mr Longhurst said the defendant refused and the conversation became heated.

He said the defendant grabbed the victim by the throat, pushed her into the lounge and shook her for about three to four seconds.

He said the defendant let go of the victim’s throat, grabbed her mobile phone and stood over her, holding the phone out of reach.

The victim screamed for help.

The defendant left the house to have a smoke.

Mr Longhurst said the victim told the defendant to leave and not come back, locking the door.

He said the defendant used keys to cut a hole in the fly screen to unlock the screen door and unlocked the door to the home before apologising to the victim.

He said that same day police attended an address and found three marijuana plants, which were 30cm tall.

Defence lawyer David Mills said his client had two children to a former partner and the victim also had two children.

Mr Mills said his client was hoping to reside with the victim.

Magistrate Philippa Beckinsale told the defendant that he should not respond the way he did.

“You cannot get physical when you are emotional,” Ms Beckinsale said.

“The victim was breaking up with you and you hold her by the throat.

“She may not want you back. That’s your plan but we don’t know what her plan is. You cannot push the issue.”

The defendant was sentenced to three months’ prison, wholly suspended for 12 months, and fined $500.

Criminal convictions were recorded.
