A woman claims she was hit so hard with a pole that she felt her arm drop and go numb, like her back had been caved in and she couldn’t breathe when allegedly attacked by a man in Woorabinda, a court has heard.

Malcolm Brian William Brown, 25, applied for bail in Rockhampton Magistrates Court on January 18.

Mr Brown was charged with 10 alleged offences, including three counts of receiving tainted property, two counts of unlawful use of motor vehicles and one count each of assault occasioning bodily harm while armed/in company and enter premises with intent.

Police prosecutor Jennifer Leach opposed bail being granted to Mr Brown, stating he presented an unacceptable risk of failing to appear and would commit further offences and endanger the safety of the alleged victim.

Ms Leach said Mr Brown allegedly used a pole to assault the alleged victim, hitting her once on the left shoulder.

“The victim stated he hit her so hard she felt her arm drop and go numb,” she said.

Ms Leach said Mr Brown then allegedly hit the alleged victim in the middle of the back.

“She felt like her back had been caved in and couldn’t breathe properly,” she said.

Ms Leach said Mr Brown followed the alleged victim to the kitchen, after she had been pulled away by his sister, and allegedly jabbed her once in the top of her right arm.

She said police had obtained a statement from the alleged victim and also relied on CCTV footage, forensic evidence and footage captured on mobile phones showing Mr Brown allegedly committing numerous property offences.

Defence lawyer Brendon Selic said his client could be bailed to live at his house in Woorabinda and that the alleged victim did not reside there, despite it being the address the alleged assault took place.

Mr Selic said most of the alleged dishonesty and vehicle offences occurred in Rockhampton and that his client would be better monitored in Woorabinda.

“Most of the (alleged) offending seems to be fuelled by alcohol, which he would have less access to in Woorabinda and would derail any further offending,” he said.

Mr Selic said the assault occasioning bodily harm charge would require case conferencing.

Magistrate Jason Schubert granted Mr Brown bail with conditions, noting he did not have any previous breach of bail condition offences on his criminal history.

Mr Brown’s matter was adjourned to February 8.
