A woman attempting to resolve an ongoing issue between a girl and her daughter grabbed the girl around the neck and continually yelled at her in a daylight assault at Yeppoon.
Kim Leanne Campton, 45, pleaded guilty in Yeppoon Magistrates Court on October 28 to unlawful assault and wilful damage.
The court heard that on September 17, about 12.28pm, a girl attended Yeppoon Police Station with her mother to report an assault.
The girl told police that about 10am, she had been walking along Charles Street, Yeppoon, when she heard someone yell out to her.
The prosecution said Campton approached the girl and grabbed her by the arm, knocking the girl’s phone out of her hand.
The prosecution said Campton yelled at the girl and grabbed her “around the neck and shoulders” while continuing to yell at her.
“The defendant has held the victim like this for a short period of time,” the police prosecutor said.
“At no point did the victim provide the defendant permission to touch her.
“At no point did the victim provoke the defendant.”
Campton picked the girl’s phone up off the ground and handed it back to her before leaving the scene.
The phone sustained damage and was cracked after hitting the ground.
Campton subsequently made admissions to police.
She said she did not intend to assault the victim or damage her phone, but “just wanted to resolve an ongoing issue” between the victim and her (Campton’s) daughter.
The court heard that Campton had no criminal history.
Her solicitor said Campton, a casual cleaner at a fruit shop, accepted that she should not have behaved the way she did.
Magistrate Jason Schubert placed Campton on a six-month good behaviour order with a $700 recognisance.
He also ordered Campton pay $399 restitution.
No conviction was recorded.
