More than one year after a grandmother was killed in her own home, lawyers for her alleged murderer are still waiting on material to complete the brief of evidence.

More than one year after a grandmother was killed in her own home, lawyers for her alleged murderer are still waiting on material to complete the brief of evidence, a court heard.

Graeme Colin Wollington, 68, was charged with the murder of his 74-year-old neighbour, grandmother Linda Kerr, in late July, 2023.

They lived in cottages near PresCare’s Alexandra Gardens on the corner of Farm and Alexandra streets, Kawana.

The cottages are not part of the aged care facility and are independent living.

Queensland Ambulance Service was called to the address at 7.29pm on July 16, 2023, for a medical incident and the matter was referred to police.

Mr Wollington’s murder charge was mentioned in Rockhampton Magistrates Court yesterday where police prosecutor Mirren Smith told the court she had been advised “some more” material for the brief of evidence would be available in November.

Defence lawyer Stephanie Nicholas advised Rockhampton Magistrates Court on March 20 that she was still making her way through the “voluminous” brief of evidence and more mental health material was likely needed.

“It’s likely we are going to have to get another psychiatric report before we can progress it,” she said.

“It’s probably going to end up in the mental health court.”

The Mental Health Court decides whether an alleged offender was of unsound mind when they committed an offence and whether they are fit for trial.

Magistrate Cameron Press responded that the case had already been subject to a suspension by the mental health court – which was lifted prior to the mention of the case on February 14.

Ms Nicholas said there were two chief psychiatrist reports from that where Mr Wollington was given “a partial defence, but they can’t refer on that basis”.

“My advice from our (Legal Aid) mental health team is we probably need to get another report,” she said.

Ms Nicholas said her next step was to submit applications for funding for another report and to send the matter back to the Mental Health Court.

There was no mention of this during the September 25 update.

Mr Wollington’s matters were adjourned to November 20 and he was remanded in custody.
