Drug user Jason Wayne Lynch once threw faeces at a prison guard

A drug-using offender who once through faeces at a prison guard through his cell food slot is in jail again after his latest offending spree.

A recidivist offender who once threw faeces at a prison guard is back behind bars after breaching the probation order for that assault 27 times.

Jason Wayne Lynch threw a container of his own faeces at the guard through the food slot in his cell door at Capricornia Correctional Centre as the guard was handing him a phone.

He was sentenced in Rockhampton District Court on December 2, 2021, to 179 days prison with 179 days presentence custody declared as time served, and placed on probation for two years.

The 40-year-old returned to the district court a year later for breaching the probation order 27 times.

In the almost eight months in the community, Lynch committed offences that breached the order.

The details of the offences were not outlined in court when he was resentenced on December 1, however Crown prosecutor Caleb Theunissan said a report provided to the court showed Lynch failed to report after his initial meeting after his release from prison on December 2, 2021.

“It’s a quite damning report with regards to breach of probation,” he said.

Defence barrister Sheridan Shaw said her client, who has mental health diagnoses, asked for help at the initial reporting with probation and parole.

“He felt they were not listening,” she said.

“He also instructed he was effectively told he was ‘only on a probation order so we’re not going to put you into the higher tiers of service and assistance because it wasn’t a parole order’.

“He effectively disengaged himself after that.

“He went to the hospital to effectively try and get some assistance with his mental health … that is an overriding factor.”

Lynch was remanded back in custody on June 28, 2022.

He was on parole at the time of committing the breach offences for a magistrates court sentence a 15-month prison term handed down in February 2020, which he is now serving out.

Judge Jeff Clarke resentenced Lynch to three months’ jail for the serious assault on a prison guard, to start after he finishes serving out the magistrates court sentence from February 2020.

His parole eligibility was set for December 1, 2022.
