A Capricornia Correctional Centre prison guard has not been able to work since January and is still subjected to medical testing after a prisoner threw faeces at him and called him a “putrid dog”.

Jason Wayne Lynch, 39, pleaded guilty on December 2 in Rockhampton District Court to one count of assaulting a corrective services officer in a prison.

Crown prosecutor Matthew Sutton said the incident was captured on CCTV.

He said Lynch threw a container of his own faeces at the guard through the food slot in his cell door as the guard was handing him a phone.

Mr Sutton said when talking with police, Lynch described the guards as “putrid dogs” and tried to justify his behaviour.

Judge Paul Smith said Lynch, who had an 11-page criminal record, behaved like an animal.

Defence barrister Ross Lo Monaco said his client acknowledge it was “disgusting behaviour”.

Mr Sutton said the victim had ongoing disease testing as a result of the incident and had experienced monetary detriment by not being able to work, which had impacted his family life.

The court heard Lynch had been trying to contact a family member on the day and had two prior failed phone calls when the incident occurred.

Lynch, calling out from the dock during Judge Smith’s sentencing remarks, said there was more to the incident than the phone calls.

Mr Lo Monaco said Lynch had a previous diagnosis of paranoid schizophrenia, but that had recently been amended to drug induced psychosis.

He said his client had been to the prison medical centre the day before claiming he was hearing voices.

Mr Lo Monaco said Lynch started using marijuana at 13, speed at 21 and had progressed to methamphetamines, had also been a binge drinker and had been dependant on morphine at one stage.

Lynch, who had served out the prison sentence he was in Capricornia for at the time of the faeces incident, was sentenced to 179 days prison with 179 days presentence custody declared as time served, and placed on a two year probation order.

A conviction was recorded.
